Elderly man said the other was called ‘Number 2’ just name calling which is the typical way to reduce one's opponent to the lesser by attacking his machismo or ego as the case maybe, the typical use of b****man, fish or faggot as well is the common use by males locally in an argument or using the castigation of one being a performer of oral sex as the subject still has some taboo attached to it and is done to embarrass persons.
A man who told Reg. Magistrate Vaugn Facey in a St Ann court that unintentional anger was the cause of him punching his neighbour in the face after he allegedly called him a homosexual was ordered to pay $20,000 to the complainant.
This after the man was brought to court for the charge of assault occasioning actualy bodily harm on Tuesday, December 11, 2012.
A dispute over the possession of a piece of land and the planting of a fence that has caused limited access to a mango tree in the Old Folly, Discovery Bay has resulted in Winston Williams punching his elderly neighbour, Daryl Earl in the left side of his face. This after, he alleged, Earl called him a homosexual. Williams said a cloud of anger surrounded him that caused him not to think.
Williams told the court that he and Earl were friends. He also told the court that he would normally take counsel from Earl as he was an elder and he enjoyed taking advice from elders.
The riff began when, according to Williams, a herd of goats belonging to Earl came onto his property and did some damage to his crops. He stated that he spoke to Earl about it.
He then proceeded to plant a fence that would keep the animals out of his farm. The fence was reportedly planted around a mango tree that was frequently accessed by community members. This did not go down well with Earl who proceeded to remove the fencing around the tree. “Your honor, him cut the fence and said everybody must get access to the tree,” Williams said.
Upon seeing the fence removed, Williams is alleged to have approached the complainant about it. An argument developed and in the process, Williams’s anger was stoked when he alleged that Earl called him a homosexual. He told the court that he got angry and hit Earl in the face.
Earl stated that Williams was the first to call him a homosexual and he simply asked him who they call “number two” the colloquial term less caustic but still hinting to someone being gay.
Earl stated that it was a name given to Williams by Bingo players. Earl also stated that he did not damage any fence. His statement was supported by the investigating officer who told the court that no fence was torn down but that the fence was removed to offer access to the mango tree.
Although Earl’s expenses as a result of the incident did not exceed $4,000, RM Facey told Williams that he was paying for the pain he caused Earl to feel.
RM Facey in his orders also instructed Williams to adjust the fence and exclude the tree so that the public can get access to the mango tree again. Williams was penitent and offered an apology to his elderly neighbour. He returned to court on January 8.
